I feel bad for the Kirby estate. Technically, yeah, Marvel's right, as Kirby was doing "work for hire" back in the day, which I can relate to as an artist/art director myself. Company's paying you to create stuff for them.
However, it'd be a show of respect and decency if Marvel/Disney would pay the estate at least an annual stipend or something (similar to what DC wound up doing with Siegel and Shuster back in the late 70s (?) when the Superman movie came out), as the Marvel Universe would likely not even exist without Kirby's imagination. Same with his work with the New Gods at DC.
